1. Acceptance of Terms

By downloading, installing, or using the Sleep Rescue mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our App.

These Terms constitute a legally binding agreement between you and Sleep Rescue ("we," "us," or "our") regarding your use of our mental health support services.

2. Description of Service

Core Features

  • AI Worry Analysis: Voice and text-based anxiety assessment and personalized recommendations
  • Emergency Crisis Support: Automatic detection of high-risk situations and emergency contact notification
  • Therapeutic Content: Curated videos, meditations, and mental health resources
  • Personalized Action Plans: Custom therapeutic interventions and resource recommendations
  • Progress Tracking: Mental health journey monitoring and analytics

Service Availability

  • Sleep Rescue is available 24/7 for worry analysis and content access
  • Emergency support features operate continuously but may have limitations based on network connectivity
  • We strive for 99.9% uptime but cannot guarantee uninterrupted service

3. Medical Disclaimers and Limitations

NOT A MEDICAL DEVICE: Sleep Rescue is not a medical device, diagnostic tool, or treatment for any medical condition. Our AI analysis is for informational and wellness purposes only.

Professional Treatment

  • Sleep Rescue does not provide medical advice, diagnosis, or treatment
  • We strongly encourage users to work with licensed mental health professionals
  • Our recommendations should not replace professional therapy, medication, or medical care
  • Always consult with healthcare providers before making treatment decisions

Crisis Intervention Limitations

  • While our AI monitors for crisis indicators, it is not infallible
  • Emergency contact notifications depend on network connectivity and contact availability
  • Users should not rely solely on Sleep Rescue during mental health emergencies
  • When in crisis, always contact professional emergency services directly

4. User Responsibilities and Conduct

Account Creation and Security

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized account access
  • You are responsible for all activities under your account

Appropriate Use

  • Use Sleep Rescue only for legitimate mental health and wellness purposes
  • Do not share content that could harm other users or violate laws
  • Respect the privacy and rights of other users
  • Do not attempt to circumvent our safety features or AI systems

Emergency Contact Management

  • Maintain current and accurate emergency contact information
  • Obtain consent from emergency contacts before adding them to your account
  • Understand that emergency contacts may receive sensitive mental health information
  • Update emergency contacts when relationships or contact information changes

5. Age Requirements and Parental Consent

Age Restrictions

  • 18+ Years: Full access to all Sleep Rescue features
  • 13-17 Years: Requires verifiable parental consent and additional monitoring
  • Under 13: Service not available

Parental Responsibilities

Parents or guardians of users under 18 must:

  • Review and approve these Terms on behalf of their minor child
  • Monitor their child's use of Sleep Rescue
  • Ensure appropriate professional mental health support is available
  • Understand that emergency notifications may be sent regarding their child

6. Privacy and Data Protection

Your privacy is paramount to us. Our data collection, use, and protection practices are detailed in our Privacy Policy, which is incorporated into these Terms by reference.

  • All data is encrypted and stored securely
  • You maintain control over your personal information
  • Emergency contact sharing only occurs during crisis situations

7. Subscription and Payment Terms

  • Basic worry analysis and AI recommendations

  • Limited access to therapeutic content
  • Basic progress tracking

Premium Subscription

  • Advanced AI Analysis: Deeper insights and personalized recommendations
  • Unlimited Content: Full therapeutic video library and resources
  • Professional Reports: Detailed analytics for healthcare providers
  • Priority Support: Faster customer service response

Billing and Cancellation

  • Subscriptions are billed through your app store account (Apple App Store/Google Play)
  • Subscriptions auto-renew unless cancelled 24 hours before renewal
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial subscription periods

8. Intellectual Property Rights

Our Content

  • Sleep Rescue owns all app content, algorithms, and therapeutic materials
  • Users receive a limited license to use our content for personal wellness purposes
  • Reproduction, distribution, or commercial use of our content is prohibited
  • Our AI models and algorithms are proprietary trade secrets

User Content

  • You retain ownership of your worry recordings and personal data
  • You grant us license to process your content for AI analysis and service improvement
  • We may use anonymized, aggregated data for research and development
  • You can request deletion of your content at any time

9. Limitation of Liability

IMPORTANT LIABILITY LIMITATIONS: To the fullest extent permitted by law, Sleep Rescue's liability is limited as described below. Please read carefully.

Service Limitations

  • Sleep Rescue is provided "as is" without warranties of any kind
  • We do not guarantee specific health outcomes or crisis prevention
  • Technical issues, network failures, or AI errors may affect service quality
  • We are not liable for decisions made based on our AI recommendations

Maximum Liability

  • Our total liability to you is limited to the amount you paid for Sleep Rescue in the 12 months before the claim
  • We are not liable for indirect, consequential, or punitive damages
  • These limitations apply even if we were advised of the possibility of damages

10. Emergency Procedures and Crisis Response

Crisis Detection Protocol

  • Our AI monitors user input for suicide ideation, self-harm indicators, and severe mental health crises
  • When high-risk situations are detected, emergency contacts are automatically notified
  • Users receive immediate access to crisis resources and professional hotlines
  • We may contact emergency services if we believe there is imminent danger

User Responsibilities During Crisis

  • Do not rely solely on Sleep Rescue during mental health emergencies
  • Contact 911, 988 (Suicide & Crisis Lifeline), or local emergency services directly
  • Inform trusted friends, family, or healthcare providers about your situation
  • Follow up with professional mental health services

11. Termination of Service

Termination by User

  • You may terminate your account at any time through app settings
  • Account deletion permanently removes your data within 30 days
  • Active subscriptions continue until the end of the billing period
  • Emergency contact information may be retained for safety purposes

Termination by Sleep Rescue

  • We may suspend or terminate accounts for Terms violations
  • Accounts may be terminated for fraud, abuse, or illegal activity
  • We provide 30 days notice for non-emergency terminations
  • Users can export their data before termination

12. Changes to Terms

We may update these Terms to reflect changes in our services, legal requirements, or business practices. When we make changes:

  • We'll notify you via email and in-app notification at least 30 days before changes take effect
  • Material changes require your acceptance to continue using the service
  • Continued use after the effective date constitutes acceptance of new Terms
  • You can terminate your account if you don't agree to updated Terms
